In November 2024 the city issued a letter of inconsistency highlighting all of the ways in which this flawed project failed to comply with city regulations. The developer appealed this decision to the planning commission who upheld the city and denied the appeal. About a month later, the developer appealed again, this time to the city council. SOS legal filings have urged the council to deny the appeal and stated all of the reason why it must.
Since that time, the city has also received a new historic report from Verplanck which documented that the project is so out of compliance with the Secretary of the Interior Standards for Historic Preservation that it could potentially cause the Sausalito Historic District to become delisted. The council has ample record of this project's flaws.
It is past time for the council to act and deny the appeal.
